Terms of Use

These Terms are an agreement between you and Norihiro Mukai (“Kigo,” “we,” or “us”). By creating an account or using Kigo, you agree to them. Please read them — especially the sections on subscriptions, disclaimers, limits on our liability, and how disputes are handled.

1. What Kigo is

Kigo lets you enhance photos and combine three photos with a short piece of writing to create a card, which you can save to your album, keep on your phone, and share.

2. Who can use Kigo

You must be at least 13 years old to use Kigo. Kigo is not intended for or directed to children under 13.

If you are under 18, you may only use Kigo with a parent or guardian involved, and only a parent or guardian may purchase a subscription. By subscribing, you confirm that you are 18 or older, or that your parent or guardian has agreed on your behalf.

Where Kigo is offered. Kigo is offered in the United States. It is not offered to, directed at, or marketed to individuals in the European Economic Area, the United Kingdom, or Switzerland, and it is not available on the App Store in those regions.

3. Your account

Keep your login details private. You are responsible for activity under your account. Tell us at support@kigo-haiku.com if you think someone else is using it.

4. Free and paid plans

Kigo has a free tier and a paid subscription.

Free. Your first three haiku cards are free, and you can save up to three enhanced photos. No account is needed to try Kigo. The current free limits are shown in the app, and we may change them.

Paid. A paid subscription unlocks unlimited cards, unlimited saving of enhanced photos, a new prompt every morning, your own album, and the option to remove the Kigo mark from your cards.

Kigo offers a monthly plan and an annual plan. The plans available to you, and their current prices, are shown in the app and on the App Store purchase screen before you buy. The price shown there at the time of purchase is the price that applies. Prices are set per country and currency through Apple’s App Store, and do not include any applicable tax unless stated otherwise.

5. Subscriptions, auto-renewal, and cancellation

Both the monthly plan and the annual plan renew automatically. Your subscription renews at the end of each billing period — one month for the monthly plan, one year for the annual plan — at the then-current price for that plan, unless you turn off auto-renewal at least 24 hours before the current period ends.

Payment is charged to your App Store account when you confirm your purchase, and again at the start of each renewal period.

We send an annual reminder for each active subscription. For annual subscriptions, this reminder is sent between 15 and 45 days before renewal. It identifies your plan, the billing frequency and amount, and how to cancel.

To cancel, open Settings on your device, tap your name, tap Subscriptions, select Kigo, and turn off auto-renewal. You can also manage your subscription at any time from the App Store. Deleting the app does not cancel your subscription.

If you cancel, you keep paid access until the end of the period you have already paid for. We do not provide partial or pro-rated refunds for the unused part of a billing period. Anything you already saved to your phone stays on your phone whether you subscribe or not.

Refunds. Purchases made through the App Store are processed by Apple, and refunds are handled by Apple under its own policies. We cannot issue refunds for App Store purchases. To request a refund, go to reportaproblem.apple.com.

Price changes. If we change the price of a plan, Apple will notify you, and where Apple requires it your subscription will not renew at the new price until you agree to it. You can cancel at any time before a change takes effect.

6. Your photos and your work

You own what you make. Your photos, your haiku, and the cards you create belong to you. We do not claim ownership of them.

What’s ours. The card design itself — the layout, the typography, the way three photos and a few words come together — belongs to us. You own your photos and your words, and you’re free to keep, print, and share the cards you make, including for your own business.

You may not use a Kigo card or the card design as your logo, trademark, or brand identity; suggest that Kigo endorses, sponsors, or is affiliated with you; or copy, extract, or resell the card design as a template.

You give us a limited permission to store, process, display, and enhance your content — only so we can operate the app for you. This permission ends when you delete the content or your account, apart from copies that remain briefly in routine backups.

We will not publish, sell, or share your content, and we will not use it to train AI models. Nothing you make is visible to anyone else unless you send it yourself.

You are responsible for having the rights to what you upload — including permission from people in your photos where that is needed.

This also means we will not feature your work in our marketing without your permission. If we ask and you decline, nothing changes about your account.

7. Things you may not do

Don’t upload content that is illegal, that infringes someone else’s rights, or that is sexual content involving minors, hateful, or violent. Don’t upload photos of people who have not agreed to it where their agreement is required. Don’t attempt to break, overload, reverse engineer, or copy the app, and don’t use it to build a competing service.

We may suspend or close accounts that break these rules.

8. Changes to the service

We may change, add, or remove features. If we make a change that significantly reduces what you get from a paid subscription, we will tell you in advance, and you may cancel.

9. The app is provided “as is”

Kigo is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that Kigo will always be available, that it will run without errors, or that it will produce any particular result. Photo enhancement is automatic, and the result may not match what you had in mind.

Nothing in this section applies to our intentional misconduct or gross negligence, and nothing in this section excludes or limits any warranty or right that cannot be excluded or limited under the law that applies to you.

10. Limits on our liability

Except in cases of our intentional misconduct or gross negligence, we are not responsible for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data.

Except in cases of our intentional misconduct or gross negligence, our total liability to you for any claim relating to Kigo is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) US$50.

Nothing in these Terms limits any liability that cannot be limited under the law that applies to you. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Kigo is not a backup service. Please keep your own copies of anything that matters to you.

11. Ending your account

You can stop using Kigo and delete your account at any time from inside the app. We may suspend or end your access if you break these Terms, or if we stop offering the service — in which case we will give you reasonable notice.

What happens to your work. If your subscription ends, we keep your photos, cards, and album for 12 months, so that everything is still there if you come back. During that time you will not be able to open your album. About a month before the 12 months are up, we will email you once to remind you. At the end of the 12 months we delete your photos, cards, album, and account.

If you delete your account yourself, your photos, cards, and album are deleted at that point, apart from copies that remain briefly in routine backups and any records we are required to keep by law.

Anything you have already saved to your own device stays on your device.

12. Governing law and where disputes are heard

These Terms are governed by the laws of Japan, without regard to conflict of laws rules. Any dispute arising out of or relating to Kigo will be brought exclusively in the Tokyo District Court, Japan.

This does not take away rights you have under the consumer protection laws of the state or country where you live, including the right to bring a claim there where the law gives you that right.

13. Other terms

If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a term doesn’t mean we’ve given it up. You may not transfer your rights under these Terms; we may transfer ours in connection with a transfer of the business.

14. Changes to these Terms

We may update these Terms. If a change is significant, we will tell you in the app or by email before it takes effect. Continuing to use Kigo after that means you accept the updated Terms.

Additional terms for the Apple App Store

These terms apply if you downloaded Kigo from the Apple App Store:

  1. These Terms are between you and us only, not with Apple. We, not Apple, are responsible for Kigo and its content.
  2. Your license to use Kigo is a non-transferable license to use it on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.
  3. Apple has no obligation to provide maintenance or support for Kigo.
  4. If Kigo fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Kigo.
  5. We, not Apple, are responsible for addressing any claims relating to Kigo, including product liability claims, claims that Kigo fails to conform to legal or regulatory requirements, and claims under consumer protection or similar laws.
  6. We, not Apple, are responsible for investigating and resolving any third-party claim that Kigo infringes that party’s intellectual property rights.
  7. You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties.
  8. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
  9. You must comply with applicable third-party terms of agreement when using Kigo.
  10. Questions, complaints, or claims about Kigo should be directed to support@kigo-haiku.com.
